Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Jobboarder platform operated by Jobboarder Ltd ("Jobboarder", "we", "us", or "our"), including the website at jobboarder.com, any job board sites hosted through our service, and all related tools, APIs, and documentation (collectively, the "Service").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- "Board" means a job board website created and operated by a User through the Jobboarder platform.
- "Board Operator" means a User who creates and manages a Board.
- "Candidate" means an individual who views or applies to job listings on a Board.
- "Content" means any text, images, data, job listings, company profiles, or other materials uploaded, created, or submitted through the Service.
- "User" means any individual or entity that accesses or uses the Service.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding legal agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Account registration
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at legal@jobboarder.com if you suspect unauthorised access to your account.
4. The Service
4.1 Platform description
Jobboarder provides a platform for creating, hosting, and managing job board websites. The Service includes tools for job listing management, company profiles, categorisation, customisation, automated job sourcing, analytics, and related features.
4.2 Service availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, deploy updates, or experience outages beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
4.3 Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For material changes that affect paying customers, we will provide at least 30 days' notice.
5. Board Operator responsibilities
As a Board Operator, you are responsible for:
- Content accuracy: Ensuring that job listings and company information on your Board are accurate, lawful, and not misleading.
- Legal compliance: Complying with all applicable employment laws, anti-discrimination laws, data protection regulations, and other legal requirements in the jurisdictions where your Board operates.
- Candidate data: Handling Candidate data submitted through your Board in compliance with applicable privacy laws. You are a data controller (or equivalent) for Candidate data collected through your Board.
- Prohibited content: Ensuring your Board does not contain content that is fraudulent, deceptive, discriminatory, defamatory, obscene, or otherwise unlawful.
6. Prohibited uses
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Post fraudulent, misleading, or deceptive job listings.
- Scrape, harvest, or collect data from the Service or other Boards without authorisation.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Attempt to gain unauthorised access to the Service, other accounts, or computer systems.
- Use the Service to send spam, unsolicited messages, or bulk communications.
- Resell or redistribute access to the Service without our written consent.
- Use automated means to access the Service except through APIs we explicitly provide.
7. Intellectual property
7.1 Jobboarder IP
The Service, including its software, design, logos, and documentation, is owned by Jobboarder Ltd and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.
7.2 Your content
You retain ownership of Content you create or upload through the Service. By submitting Content, you grant Jobboarder a worldwide, non-exclusive, royalty-free licence to host, store, display, and distribute that Content solely to provide and promote the Service.
7.3 Feedback
If you provide suggestions, ideas, or feedback about the Service, we may use them without obligation or compensation to you.
8. Payment and billing
8.1 Subscription plans
Certain features of the Service require a paid subscription. Pricing, features, and plan details are described on our website and may change with 30 days' notice for existing customers.
8.2 Billing cycle
Subscriptions are billed in advance on a monthly or annual basis, depending on your chosen plan. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.
8.3 Payment processing
Payments are processed by our third-party payment provider. You agree to provide accurate billing information and authorise us to charge your payment method for applicable fees.
8.4 Refunds
We do not provide refunds for partial billing periods. If you cancel your subscription, you will retain access to paid features until the end of your current billing period.
8.5 Taxes
All fees are exclusive of applicable taxes (VAT, sales tax, etc.), which will be charged as required by law based on your billing address.
9. Data and privacy
Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
10. Third-party services
The Service may integrate with third-party services (payment providers, analytics tools, email services). Your use of these services is subject to their own terms and privacy policies. Jobboarder is not responsible for the practices of third-party services.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBBOARDER DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not endorse or guarantee the accuracy of any Content posted by Users.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBBOARDER'S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO JOBBOARDER IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (GBP 100).
IN NO EVENT SHALL JOBBOARDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.
These limitations apply even if Jobboarder has been advised of the possibility of such damages.
13. Indemnification
You agree to indemnify and hold harmless Jobboarder, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your Content, your violation of these Terms, or your violation of any third-party rights.
14. Termination
14.1 Termination by you
You may cancel your account at any time through your account settings or by contacting us at legal@jobboarder.com.
14.2 Termination by us
We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law. For paying customers, except in cases of material breach, we will provide 14 days' notice before termination.
14.3 Effect of termination
Upon termination, your right to access the Service ceases. We will retain your data for 30 days to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.
15. Dispute resolution
15.1 Governing law
These Terms are governed by the laws of England and Wales.
15.2 Jurisdiction
Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15.3 Informal resolution
Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@jobboarder.com. We will attempt to resolve the matter within 30 days.
16. General provisions
16.1 Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jobboarder regarding the Service.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
16.4 Assignment
You may not assign your rights under these Terms without our consent. We may assign our rights and obligations without restriction.
16.5 Notices
We may provide notices to you by email to the address associated with your account or by posting on the Service. Notices to Jobboarder should be sent to legal@jobboarder.com.
